Talken — Terms of Service

By accessing or using Talken ("Services"), you agree to these Terms.

The Services are currently offered as a test launch. They are experimental, may be discontinued or changed at any time without notice, and are provided by independent developers and contributors. No company, partnership, or legal entity is implied unless explicitly stated.

If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and legally able to enter into agreements. You are responsible for complying with laws in your jurisdiction.

2. Nature of the Services

Talken is a non-custodial, experimental software application built on public blockchain infrastructure. The current offering is a test launch. We have no obligation to maintain, support, or continue the Services.

We do not:

  • custody assets
  • control user wallets
  • execute transactions on your behalf
  • guarantee uptime

3. Non-Custodial Use

You retain full control over:

  • wallets
  • private keys
  • seed phrases
  • device security

We cannot recover lost keys or reverse blockchain transactions.

4. User Responsibilities

You agree not to:

  • use the Services for illegal purposes
  • transmit unlawful or harmful content
  • exploit bugs or vulnerabilities
  • attempt to interfere with network operations

You are solely responsible for your transactions.

5. Blockchain Risks

By using Talken, you acknowledge:

  • Transactions are irreversible
  • On-chain data is immutable
  • Encrypted data may remain permanently visible in encrypted form
  • Smart contract vulnerabilities may exist
  • Network congestion and forks may occur

6. No Financial Advice

Nothing provided by Talken constitutes financial, investment, tax, or legal advice.

Digital assets are volatile and risky.

7. Intellectual Property

The Talken interface, branding, and related materials are protected by intellectual property laws unless otherwise stated.

Open-source components remain subject to their respective licenses.

8. Termination

We may suspend or discontinue the Services at any time without notice.

You may stop using the Services at any time.

9. Limitation of Liability

To the maximum extent permitted by law, the developers and contributors of Talken shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • loss of funds
  • loss of data
  • smart contract exploits
  • network failures
  • third-party service outages

In no event shall our aggregate liability exceed the greater of (a) USD $100 or (b) the amount you paid to use the Services in the past 12 months (if any).

10. Indemnification

You agree to defend, indemnify, and hold harmless the developers and contributors of Talken from any claims, damages, or expenses arising from:

  • your use of the Services
  • your violation of these Terms
  • your infringement of third-party rights

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the courts of [Your Jurisdiction].
